1. INTRODUCTION
Welcome to AbhaMart, an online platform operated by AbhaMart E-Commerce Services Pvt. Ltd. (“AbhaMart”, “we”, “our”, or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website, and related services (collectively called “Platform”).
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please stop using the Platform immediately.
2. DEFINITIONS
• User: Any person accessing or using AbhaMart (includes buyers, sellers, vendors, or visitors).
• Customer/Buyer: Any individual or entity purchasing goods or services through AbhaMart.
• Seller/Vendor: Any retailer, wholesaler, distributor, or manufacturer registered to sell products on the Platform.
• Product: Any item or service offered for sale through AbhaMart.
• Account: The registered user profile used to access the Platform.
• Services: All online features, facilities, and assistance provided by AbhaMart.
3. ELIGIBILITY
• You must be 18 years or older to use AbhaMart.
• You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
• If you represent a business, you confirm that you are authorized to bind that business.
• AbhaMart reserves the right to refuse access or terminate accounts at its discretion.
4. ACCOUNT REGISTRATION AND USE
• Users must create an account using valid information (name, phone number, email, address).
• You agree to maintain the confidentiality of your login credentials.
• You are solely responsible for all activities under your account.
• AbhaMart may verify your information and suspend accounts found using false or incomplete data.
• You must notify us immediately if you suspect unauthorized use of your account.
5. ABOUT ABHAMART SERVICES
AbhaMart is a digital marketplace platform that connects customers with local shops, retailers, and wholesalers for the sale and purchase of goods.
AbhaMart:
• Does not own or control products sold by vendors.
• Acts as an intermediary facilitating order placement, payment, and communication.
• Provides digital infrastructure for discovery, ordering, logistics, and payment services.
6. VENDOR / SELLER TERMS
If you are a seller or vendor on AbhaMart, you agree to:
• Provide complete and accurate business documents (GSTIN, PAN, bank details, trade license, etc.).
• Upload only genuine products with correct descriptions, pricing, and stock details.
• Not sell counterfeit, expired, restricted, or illegal goods.
• Fulfill orders on time and handle packaging responsibly.
• Manage returns, replacements, and refunds as per your stated policy.
• Abide by applicable laws and tax regulations in India (e.g., GST Act, Consumer Protection Act).
• Grant AbhaMart the right to use product images, descriptions, and offers for marketing purposes. AbhaMart reserves the right to:
• Inspect listings, remove non-compliant products, or suspend vendors.
• Charge service or subscription fees as agreed.
• Terminate or block sellers for repeated violations.
7. CUSTOMER TERMS
Customers agree to:
• Use the Platform only for legitimate, personal, or business purchases.
• Provide accurate contact and delivery details.
• Make timely payments through approved channels.
• Not misuse offers, coupons, or referral systems.
• Accept deliveries responsibly and check items before accepting them.
Any misuse, fraud, or policy violation may lead to suspension or blacklisting of your account.
8. ORDER PROCESSING
• All orders placed through AbhaMart are subject to acceptance by the seller.
• Product prices, stock, and availability are dynamic and may change without notice.
• AbhaMart may cancel or modify orders due to unavailability, payment failure, or policy breach.
• Order confirmation is sent via SMS/email/notification once accepted.
9. PRICING AND PAYMENTS
• All prices are displayed in Indian Rupees (INR).
• Prices may include or exclude taxes depending on seller policy.
• Payments are accepted through secure payment gateways (UPI, credit/debit cards, wallets, etc.).
• AbhaMart may act as a payment collection agent on behalf of sellers.
• In case of failed transactions or refunds, processing will occur within 5–15 working days.
10. DELIVERY AND SHIPPING
• Delivery is handled by sellers or third-party logistics partners.
• Estimated delivery times are shown during checkout but may vary.
• The risk of loss or damage passes to the buyer upon delivery.
• AbhaMart is not liable for delays or losses caused by logistics providers or unforeseen events.
11. CANCELLATION, RETURN & REFUND POLICY
(a) Cancellations:
• Buyers can cancel an order before dispatch.
• Sellers can cancel if the product is unavailable or in case of pricing/stock errors.
(b) Returns & Replacements:
• Returns or replacements are accepted only under the seller’s specific policy.
• Categories like perishables, hygiene items, and personal care products may not be returnable.
(c) Refunds:
• Refunds are processed once the returned product passes inspection.
• Refunds will be credited to the original payment source.
• AbhaMart may deduct service or handling charges, if applicable.
12. SUBSCRIPTIONS AND PREMIUM PLANS (FOR VENDORS)
AbhaMart offers Different types of subscription plans for vendors.
• Each plan comes with specific limits and features (e.g., product listing limit, ad promotion, analytics).
• Subscription fees are non-refundable except in case of technical failure or legal requirement.
• Non-payment or expiry of subscription may result in downgrade or suspension of account.
13. CONTENT AND INTELLECTUAL PROPERTY
• All content on the AbhaMart Platform (text, logos, design, software, graphics, etc.) is owned or licensed by AbhaMart.
• Vendors retain rights over their product content but grant AbhaMart a non-exclusive, royalty-free license to use it for promotion and operation.
• You may not reproduce, copy, or distribute any part of the Platform without written consent.
14. PROHIBITED USES
You agree not to:
• Use the Platform for any unlawful or fraudulent activity.
• Upload or sell counterfeit, stolen, or restricted products.
• Interfere with the Platform’s operations (hacking, scraping, reverse engineering).
• Spread malware, spam, or offensive material.
• Circumvent payment or communication systems to avoid platform charges.
Violation may result in permanent account termination and legal action.
15. LIMITATION OF LIABILITY
• AbhaMart acts only as an intermediary between buyers and sellers.
• We are not responsible for product quality, delivery issues, or warranty disputes.
• AbhaMart shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of the platform.
• In no case shall AbhaMart’s total liability exceed the amount paid by you for the specific transaction in question.
16. INDEMNIFICATION
You agree to indemnify and hold AbhaMart, its officers, employees, partners, and affiliates harmless from any loss, claim, or liability arising from:
• Violation of these Terms,
• Use or misuse of the Platform, or
• Infringement of any third-party rights.
17. PRIVACY AND DATA PROTECTION
Your privacy is important to us.
• AbhaMart collects and processes data in accordance with its Privacy Policy.
• Data may be used to provide services, verify identity, prevent fraud, and improve user experience.
• AbhaMart does not sell or rent user data to third parties.
• For marketing or notifications, you consent to receive SMS, email, or WhatsApp updates, which you can opt out of anytime.
18. TERMINATION AND SUSPENSION
AbhaMart may suspend, limit, or terminate your account if you:
• Violate any clause of these Terms;
• Engage in fraudulent or abusive behavior;
• Fail to pay applicable fees or dues.
You may delete your account by contacting our customer support.
Certain transactional data may be retained as required by law.
19. COMMUNICATION AND NOTICES
By using the Platform, you agree to receive electronic communications from AbhaMart.
Official notices shall be sent via:

• Notifications within the App.

20. GOVERNING LAW AND DISPUTE RESOLUTION
• These Terms shall be governed by and construed in accordance with the laws of India.
• All disputes shall be subject to the exclusive jurisdiction of the courts in Kanpur, Uttar Pradesh, India.
• Parties shall first attempt to resolve disputes amicably through negotiation or mediation.
21. MODIFICATION OF TERMS
AbhaMart reserves the right to change, update, or replace any part of these Terms at any time.
Updated versions will be posted on the Platform with a revised “Last Updated” date.
Your continued use of the Platform signifies your acceptance of the revised Terms.
